Palm Center LogoThe Palm Center, a research institute at the University of California, Santa Barbara, today released a legal memo that outlines what steps the Secretary of Defense can take to modify the enforcement of "don't ask, don't tell" while the President works with Congress to repeal the law. The document serves as a follow-up to the Palm Center's heavily debated May study explaining options for executive action that could halt all discharges even without an act of Congress. Previous to its release, most analysts had assumed that only Congressional action could end the firings, which President Obama has vowed to do since early in his campaign.

US Attorney General Pushes For New Hate Crimes Law PDF Print E-mail

U.S. Attorney General Eric Holder is calling on Congress to pass a new, expanded hate crimes law that would permit the federal government to prosecute cases of violence based on disability, gender and sexual orientation.  Democrats have been trying to update the current hate crimes law for more than a decade, which already makes it a federal crime to attack someone because of their race, creed or color.

Lawsuit Filed Challenges California Anti-Gay Marriage Amendment PDF Print E-mail

A class action lawsuit Burns v. State of California was filed on behalf of unmarried gays and lesbians in San Francisco Superior Court today, Friday June 26, 2009, one day before San Francisco's gay pride festival. This will be the first case in California's State Court challenging California's new Constitutional amendment limiting marriage to heterosexual couples. The Plaintiffs are represented by attorney Waukeen McCoy who successfully argued In Re Marriage Cases in 2008, which briefly allowed homosexuals the right to marry in California.

77 Members of Congress Urge Obama to Suspend DADT PDF Print E-mail

In a letter sent to President Obama today, seventy-seven members of Congress called on the White House to issue a moratorium suspending gay discharges from the military. The new strategy envisions immediate executive action, to be followed by legislative repeal of the "don't ask, don't tell" law at a subsequent time. The letter calls on the President "to exercise the maximum discretion legally possible in administering 'don't ask, don't tell' until Congress repeals the law."
